Terms and Conditions
These terms and conditions (the “Terms”) apply to the Malfy x Rixo giveaway.
These Terms will prevail in the event of any conflict or inconsistency with any other communications or promotional materials. Entry instructions are deemed to form part of the Terms and by participating all entrants will be deemed to have accepted and be bound by these Terms. Please retain a copy of these Terms for your information.
1. Promoter: Pernod Ricard UK Limited, Building 7 Chiswick Park, 566 Chiswick High Road, London, W4 5YG. Please do not send entries to this address.
2. Eligibility: Promotion open to residents of the United Kingdom (England, Scotland, Wales and Northern Ireland but excluding residents of the Channel Islands) aged 18 years and over, except employees and families of the Promoter and its affiliate companies, agencies and anyone professionally connected with the Promotion.
3. Promotional Period: The Promotional Period shall begin at 00:01 GMT on 17th September 2021 and end at 23:59 GMT on 24th September 2021.
4. Entry Instructions
4.1 Entrants must:
a. Follow both @malfygin and @rixo on Instagram;
b. Like the post on Malfy’s Instagram page which details this Promotion;
c. Tag two friends in the comments who you think would also like to enter.
No purchase necessary. Entry is free.
4.3 Entrants can enter as many times as they wish across the Promotional Period but each entrant can only win once.
5.1 There will be six prizes available (collectively, the “Prizes”) and each Prize shall consist of:
i. 1 Rixo beach towel;
ii. 2 x Malfy branded gin glasses;
iii. 1 x Malfy Con Arancia Gin 70cl;
iv. 1 x Malfy Con Limone Gin 70cl; and
v. 1 x Malfy Gin Rosa Gin 70cl.
6. Winner Selection
6.1 Six entrants will be chosen via randomised computer process. The two friends who are tagged do not count as entrants and are not eligible to win. Each winner will be contacted by Instagram direct message by Friday 1st October.
6.2 All winners will be asked to verify that they are over 18 before as well as to provide their address for delivery.
6.3 Where a winner fails to respond to the Instagram message within 5 working days, a new winner will be chosen via the same process.
7. Personal Data
7.1 By tagging two friends, each entrant confirms that they have those friends’ permission to tag them.
7.3 In the event that a reasonable request is made, including by the Advertising Standards Authority or any other competent body, the Promoter will provide the surname and county of residence of the winner of the main cash prize.
8.1 The Promoter accepts no responsibility for entries that are lost, delayed or damaged for any reason whatsoever. Incomplete entries or those not in accordance with the entry instructions will not be accepted.
8.2 Entrants agree that, to the extent permissible by law, the Promoter assumes no liability for injuries, losses or damages or any kind to property or persons, including without limitation death, resulting in whole or part, directly or indirectly, from the management of or mechanics behind the Promotion, entry into the Promotion, the acceptance of the Prizes, and any acts or omissions of the winners. Nothing will exclude the Promoter’s liability for death or personal injury as a result of its negligence.
8.3 In the event of circumstances outside the reasonable control of the promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this Promotion or the awarding of the Prizes, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the Promotion or these terms and conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
8.4 The Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. The entrant acknowledges that Instagram does not accept any liability whatsoever for any damages which may be incurred as a result of entry into this Promotion. Entrants must adhere to the terms and conditions of use of Instagram.
8.5 These Terms (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law. Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issues.
